Music Stores Terms of Service ("Agreement")

Please read these Terms of Service ("Agreement", "Terms of Service") carefully before using www.musicstores.in ("the Site") operated by Music Stores ("us", "we", or "our"). This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.musicstores.in.
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement.
The Site and its original content, features and functionality are owned by Music Stores and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Andhra Pradesh, India, without giving effect to any principles of conflicts of law.
You agree to be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of the Site and Services, and you shall be responsible for all charges related thereto.
You understand that we cannot and do not promise, guarantee or warrant that files you download through the Internet will be free from viruses, worms, Trojan horses or other code that may be destructive. You are responsible for implementing sufficient safeguards for yourself. We do not assume any responsibility for your use of the Internet.
Every order issued by the customer(s) shall not be binding on the company unless acknowledged by the company in writing.The orders which are once cancelled by the company for any reason the customer will be refunded the complete amount if the payment mode is Card.If the payment mode is COD the order will be cancelled by informing the customer. The Company reserves its right to refuse orders at its sole discretion with out assigning any reasons.
The content of the Site and/or Services may not be complete or up-to-date and should not be used to replace any other statements or notices provided by us. Information obtained by using the Site and/or Services is not exhaustive and does not necessarily cover all relevant issues.

Music Stores, its parents, subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors (collectively, hereafter in this paragraph, “ music stores”) will not be liable for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including loss of revenue or income, pain and suffering, emotional distress, or similar damages, even if advised of the possibility of such damages.
All products sold on the Site are sold with the warranty of their respective manufacturers and with the Music Stores 15 days return/price protection policy. Except for those warranties and any other written warranty shown on the Site or purchased on the Site all products and Services are sold without warranty express or implied, and include no warranty of fitness for a particular purpose.
All comments, reviews, articles, sound files, videos, and photographs (collectively “Submitted Content”) you submit to Music Stores directly or through user surveys become the property of Music Stores and, except as otherwise specifically stated on the Site, you grant a perpetual, non-exclusive, royalty free license giving Music Stores the right to use the Submitted Content for any purpose, including, but not limited to the advertising and promotion of the Site and the Services.
Security and Privacy
Any passwords used for registration on the Site are for individual use only. You are solely responsible for the security of your password. We may monitor your password and, at our discretion, require you to change it. If you use a password that we consider insecure, we may require it to be changed or we may end your account.
BY ACCEPTING THIS AGREEMENT YOU WAIVE AND HOLD HARMLESS MUSIC STORES FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY MUSIC STORES DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER MUSIC STORES OR LAW ENFORCEMENT AUTHORITIES.
You agree that Music Stores in its sole discretion, shall have the right, but not the obligation, to edit, refuse to post or remove any Submitted Content, for any reason whatsoever, including, without limitation, if Music Stores considers that the Submitted Content constitutes or promotes gambling or any illegal activity, or if Music Stores considers the material to be pornographic, sexually explicit, lewd, lascivious, filthy, excessively violent, harassing or otherwise objectionable. Notwithstanding the foregoing, you shall remain solely responsible for the content of material you upload, post or otherwise make available on the Site or the Services. Furthermore, you acknowledge that the Site and Services may not be monitored and that you do not rely on Music Stores to monitor or edit the Site or Services and that the Site or Services may contain content which you find offensive, and you hereby waive any objections you might have with respect to viewing such content.
Changes To This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
Returns & Refunds
We truly appreciate your business and want you to be nothing short of delighted with your purchase! Every item we sell is new and covered by the full manufacturer's warranty. If for any reason you are not completely satisfied with an item, return it within 10 days after receiving the Shipment i.e if you receive the shipment on 01/12/2015 you can return it on or before 10/12/2015.
Please do not accept any shipment if the packaging appears damaged in any way.We strongly suggest that you check your order after receiving it to be sure that it is in proper working order.
Returning an Item
If you feel the need to return an item, it must be in resalable condition. Resalable Condition means that the product(s) is in exactly the same condition as it was when you received it.
All exchanges and returns should be in original packing, complete with blank warranty cards, owner's manual and no sign of wear or abuse. In the event that the product is not in the same condition as you received it, you may be subject to disqualification.
Shipping and handling charges will be refunded if the product you received is damaged in transit. Shipping and handling charges will be charged if the product is in good condition and you still wanted to return it.
Please do not hesitate to check the product thoroughly after receiving the product. It is your right & responsibility to check the product well before the return window is closed. The store will not cover any physical damages after the return window is closed.
Do not worry if you need to return the shipment. It is hassle free with our Fed Ex return shipping method. Please keep the package ready for return, our executive will pickup the product from your door step which is completely free of cost *.
Note - In case Music Stores is unable to pick-up your shipment due to certain unforeseen circumstance, you may have to ship the products to our facility. The logistic charges involved in these cases would be refunded back to you after the product reaches us.
All the Cash on Delivery payments will be refunded either in the form of Check or Bank Remittance as per customer convenience. Account details will be collected from the customer after receiving the return request.
Card Payment Returns
All the card payments Debit/Credit amounts will be refunded within 2-3 working days after receiving the request.
CDs, DVDs, video tapes, sheet music, books, strings, computer hardware/software, drum heads, harmonicas, mouthpieces, sound cards, microphones, raw speakers, studio furniture, blank CDs/tapes or special orders are not covered by this return policy.
Refunds are initiated only after we receive the product from the customer.

Cancellations: For any reason if you would like to cancel the order the following scenarios need to conisidered
i) Oder with Preparation-In-Progress/Awating Cod Validation/ Awaiting Payment Confirmation status means the order is not yet shipped in this case if you would like to cancel the order you can login into the account and place the cancellation request or you can mail us at email@example.com from the same email-id through which the order is placed. For customers who made online payment, amount will be refunded to them within 2 to 3 working days.
ii) Order with shipped status cannot be cancelled. If you would like to cancel the order for any reason after the product is shipped to you, you need to wait until the product reaches you and then you can place a return request by login into the account or you can mail us at firstname.lastname@example.org from the same email-id through which the order is placed along with the order reference.
Please note: Amount will refunded after we receive the shipment back.
1. Warranty cannot be claimed without invoice and warranty card.( Warranty card is mandatory for Keyboards and all Electronic equipments)
2. Products under warranty qualify, only for service and not for replacement.
3. Warranty is not covered for adapters, physical damages and strings.
4. Warranty is not applicable if the Instrument is damaged due to poor maintenance or physical damage.
5. Service will be provided only for manufacturing defects. Service center reserves the full right to decide if the defect is a manufacturing defect or not.
6. If a product is covered under warranty and the service center determines it to be manufacturing defect or un repairable, a credit note will be issued in return/exchange of the goods which will be valid for 1 year.
7. Every manufacturer has different warranty period please check with the store for time frame which is covered.
8. If you are not located in a place which is near to service center, Music Stores will help you in getting the product pickedup from the location and getting it repaired and delivering it backto you. Packing charges, delivery charges and repair charges (if any) will be charged to the customer.
Shipping policy: We try our best to deliver the product on time and meet your expectations, for which we have divided our product range and time taken to deliver them as per the following method:
If the product page says “We Dispatch in 24 to 48” or Dispatch within Few Hours” that means the product is at our delivery location and it will be tested and dispatched.
If the product page says “ We Dispatch with in Indicated Days” that means the product need to moved from our other location to delivery location and it will be tested and dispatched. In case of special orders the products will be moved from our supplier location to our delivery location and then it will be tested and dispatched. This might take some time which differs from product to product.
Music Stores does not charge any shipping charges to the customer, all our products will be delivered free of cost. We charge only if the shipping location is a remote location and our courier service partner does not have delivery.
In case of any changes in the shipping time our team will update you and take the approval for the dispatch.

Is your product safe & insured?
Yes your product is damage and theft insured. Though the shipping is handled carefully there are some chances that the transport vehicle may meet some accident or some theft. So we insure all the products.
Delivery charges varies with time, distance and weight. How ever we do not charge any shipping charges to our customers unless it is a remote location.
There are NO hidden charges when you make a purchase on Music Stores. List prices are final and all-inclusive. The price you see on the product page is exactly what you would pay.
